ORLANDO — Two Orlando property owners are suing an insurance company, alleging breach of contract.
Kimberly Kansier and Cara Kansier filed a complaint April 25 in Orange County Circuit Court against People's Trust Insurance Company, alleging the insurer failed to pay for property damages caused by a hurricane.
According to the complaint, on Sept. 10, 2017, while their insurance policy was in full force and effect, the Kanslers' property at 4502 Santee St., Orlando, sustained a covered loss due to Hurricane Irma. However, the suit says People's Trust has refused to pay all benefits due and owing, thereby breaching the policy.
The plaintiffs allege People's Trust Insurance has failed to fully pay the Kanslers' claim contrary to the terms of the policy, failed to pay for additional coverage including debris removal, repairs and mold remediation, and made unlawful representations regarding the terms and conditions of the policy.
The Kanslers seek trial by jury, damages of more than $15,000, interest, other additional expenses, interest, attorney fees, court costs and all other relief the court deems just. They are represented by attorneys Chelsea E. Haritan and Elizabeth Kim of Haritan Law PA in Pompano Beach.
