ORLANDO — A visitor is suing the business owner and operator of an Orlando doctor's office, alleging insufficient measures were taken to prevent injuries.

Robert Wesley filed a complaint April 25 in Orange County Circuit Court against Dr. Richard S. Altman, alleging negligence in failing to provide a reasonably safe business premises.

According to the complaint, on Dec. 28, 2015, Wesley was conducting business on Wesley premises, 338 N. Magnolia Ave., Orlando, when he slipped and fell on a tear in the carpet on the staircase. As a result, Wesley says, he suffered bodily injuries resulting in pain, disability, aggravation of a pre-existing condition, mental anguish and loss of earnings, plus the expense of hospitalization, medical and nursing care and treatment. 

The plaintiff alleges Altman failed to maintain the premises in a safe condition by allowing the ripped carpet on the staircase to remain unfixed, failing to repair the tear in the carpet, failing to regularly inspect the premises for faulty grounds, and/or failing to warn business invitees of known dangers related to such defects.

Wesley seeks trial by jury, damages that exceed $15,000, excluding interest, court costs and attorney fees, plus all further relief the court deems proper. He is represented by attorneys Tyrone A. King and Alicia Peyton of King & Markman PA in Orlando.
