FORT LAUDERDALE — A West Park resident is suing an insurance company, alleging breach of contract.
Sylvia Mitchell filed a complaint April 25 in Broward County Circuit Court against Olympus Insurance Company, alleging the defendant failed to provide necessary reimbursement for covered losses in accordance with the policy.
According to the complaint, on Dec. 27, 2016, Mitchell's property at 119 Virginia Road, West Park, suffered covered losses and she made a claim in according with the policy. Mitchell says the policy was in full force and effect while the property sustained the loss, she provided timely notice of the claim and she complied with all conditions and obligations imposed by the policy.
However, Mitchell says, she was denied of full coverage.
The plaintiff alleges Olympus Insurance has denied the claim and only made a small partial payment with regard to the loss and has failed to timely evaluate and pay the benefits due and owing under the policy.
Mitchell seeks trial by jury, damages of at least $15,000, plus pre- and post-judgment interest, attorney fees, court costs and all other relief deemed just and fit. She is represented by attorney Robert Delgado of Litigation & Recovery Law Center PL in North Miami Beach.
