ORLANDO — A customer is suing BMW, alleging breach of warranty.
John Gianitsis filed a complaint April 16 in Orange County Circuit Court against BMW of North America alleging, violation of the Magnuson-Moss Warranty Act.
According to the complaint, on Nov. 24, 2017, Gianitsis bought a used 2014 BMW 6501 convertible for $46,895. The suit says he relied on BMW's warranty that the vehicle was in good condition when, in reality, ineffective repair attempts had been made to the vehicle.
The plaintiff alleges BMW of North America impaired the use, value and/or safety of the vehicle, failed to adequately repair the defects or replace the defective vehicle.
Gianitsis seeks trial by jury, incidental and consequential damages of more than $15,000, attorney fees, witness fees, court fees and all further relief the court deems just. He is represented by attorney Nicholas Lacina of Krohn & Moss Ltd. in Chicago.
