ORLANDO — Two Orlando homeowners are suing an insurance company, alleging breach of insurance contract.
James Angel and Kathryn Angel filed a complaint April 2 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging the defendant breached the insurance contract by wrongfully denying benefit payments.
According to the complaint, on Sept. 10, 2017, the Angels' property at 1606 Montcalm St. Orlando, suffered significant damaged caused by Hurricane Irma and immediately issued a completed form to American Integrity delineating damages of $107,857.18.
Despite timely notifying the defendant and performing all obligations required under the insurance contract,.the Angels allege they failed to receive any payment to cover their losses.
The plaintiffs allege American Integrity Insurance failed to make complete payments within the time prescribed by Florida l;aw and failed to pay insured covered losses plus penalty, interest, and postage despite the fact that it had no reasonable proof to establish that it is not responsible for the payment.
The Angels seek trial by jury, covered damages, plus pre- and post-judgment interest, all interest on any past benefits not timely paid, court costs, attorney fees and legal assistant fees. They are represented by attorney Jose F. Garcia of J. Garcia Law Firm PA in Kissimmee.
