ORLANDO — An Orlando couple is suing an insurance company, alleging refusal to apply damage payments.

Ana and Thomas Hidalgo filed a complaint April 2 in Orange County Circuit Court against Universal Insurance Company of North America, alleging the defendant did not comply with its obligation to acknowledge the insured's claim after a hurricane.

According to the complaint, on Sept. 10, 2017, the Hidalgos' home at 5787 Vista Linda Drive, Orlando, sustained damage from Hurricane Irma while their insurance policy was in full effect. The Hidalgos say Universal inspected the loss but wrongfully determined the plaintiffs' claim was not covered. 

The suit says the Hidalgos notified the defendant that they were in disagreement with its evaluation and demanded payment in accordance with the terms of the policy. The plaintiffs allege Universal Insurance has failed to acknowledge that payment for the insurance coverage would be forthcoming.

The Hidalgos seek trial by jury, damages of more than $15,000, prejudgment interest, attorney fees and court costs. They are represented by attorneys Stephanie Balint and Robert L. Gioia of Homeowner Legal Solutions LP in Plantation.
