ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.

Carmen Burgos filed a complaint March 30 in Orange County Circuit Court against Modern USA Insurance Company, alleging the insurer failed to cover damages from a plumbing problem. 

According to the complaint, on Jan. 13, while Burgos' property at 5445 Lehigh Ave., Orlando was insured by Modern USA it sustained a covered loss from an accidental discharge of water from a plumbing system. However, the suit says, the defendant has refused to pay Burgos an adequate amount of insurance proceeds to replace and repair the property. 

The plaintiff alleges Modern USA Insurance obligated Burgos to engage attorneys for the prosecution of action, and failed and/or refused to pay her the full amount of insurance proceeds as a result of the loss.

Burgos seeks trial by jury, damages in excess of $15,000, plus statutory interest, court costs and attorney fees. She is represented by attorneys Pierre A. Louis and Ricco C. Washburn of Louis Law Group PLLC in Miramar.
