Orlando homeowner alleges insurer failed to cover water damage

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.

Dennis Rodriguez filed a complaint March 30 in Orange County Circuit Court against Florida Specialty Insurance Company, alleging failure to cover water damages. 

According to the complaint, on July 11, 2017, Rodriguez's insured property at 12102 Poppy Field Lane, Apartment 105, Orlando, sustained a sudden and accidental covered loss as a result of a pipe break in the bathroom. 

However, the suit says, Florida Specialty issued payment for the plaintiff's claims at an insufficient amount to restore the property to its pre-loss condition. 

The plaintiff alleges Florida Specialty Insurance has delayed the claim intentionally in an attempt to prevent him from continuing to pursue claim payments.

Rodriguez seeks trial by jury, damages of more than $15,000, including all contractual benefits, prejudgment interest, costs, attorney fees and all further relief the court deems just and proper. He is represented by attorneys Matthew G. Struble and Christine M. Deis of Struble PA in Fort Lauderdale.
