Fort Lauderdale property owners allege insurer failed to provide hurricane coverage

FORT LAUDERDALE — Two Fort Laderdale property owners are suing an insurance company, alleging breach of contract after a hurricane.

Romy Barden and Craig Lewis filed a complaint on March 23 in Broward County Circuit Court against Avatar Property & Casualty Insurance Company, alleging the defendant refuses to pay all benefits due and owing.

According to the complaint, on Sept. 10, 2017, Barden and Lewis sustained damage to their property at 2454 Gulfstream Lane, Fort Lauderdale, as a result of Hurricane Irma. The suit says the plaintiffs gave Avatar Property timely notice of their claim and have complied with all terms and condition of the policy but have not received any coverage pursuant to the insurance. 

The plaintiffs allege Avatar Property & Casualty Insurance failed to pay the insured benefits due and owing for the covered losses that the property sustained as provided for in the policy.

Barden and Lewis seek trial by jury, judgment for benefits together of more than $15,000 with prejudgment interest, court costs, attorney fees, and all other relief the court deems proper and just. They are represented by attorneys Michael D. Leader and Scott R. Zucker of Leader & Leader PA in Fort Lauderdale.
