CLEARWATER — Two Seminole homeowners are suing an insurance company, alleging breach of an insurance contract.
Jean Wargo and Dale Marion filed a complaint March 27 in Pinellas County Circuit Court against Florida Peninsula Insurance Company, alleging the defendant has refused to honor the plaintiffs' compensation claim.
According to the complaint, on Sept. 10, 2017, Warto and Marion notified Florida Peninsula of the damage their property at 13569 91st Ave., Seminole, had sustained due to Hurricane Irma. They allege their insurance policy was in full force and effect and that they have complied with all condition precedent to entitle them to recover under the policy.
The suit says Wargo and Marion did not receive any insurance coverage needed for their losses. The plaintiffs allege Florida Peninsula Insurance has refused to pay for all insured losses.
Wargo and Marion seek trial by jury, compensation of more than $15,000 for all covered losses with interest on any overdue payments, attorney fees and costs. They are represented by attorney Jeffrey Constantinos of Morgan & Morgan, PA in Tampa.
