ORLANDO — Two Orlando homeowners are suing an insurer, alleging breach of contract.

Maria Estupinan and Juan Ruiz filed a complaint March 19 in Orange County Circuit Court against Southern Fidelity Property and Casualty Inc., alleging failure to cover damages caused by a hurricane. 

According to the complaint, on Sept. 13, 2017, the insured home of Estupinan and Ruiz at 826 Virginia Woods Lane, Orlando, sustained substantial damages due to Hurricane Irma. However, the suit says, Southern Fidelity refused to provide coverage for the damages despite having received and processed the plaintiffs' timely notice of the loss. 

The plaintiffs allege Southern Fidelity Property and Casualty has refused and continues to refuse to pay the full amount of the plaintiffs' claim against terms of the policy, and forced Estupinan and Ruiz to retain legal services to prosecute the matter.

Estupinan and Ruiz seek trial by jury, damages of more than $15,000, court costs, interest, attorney fees and all other relief the court deems just. They are represented by attorney Robin A. Richison of Militzok & Levy PA in Hollywood.
