ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.
Oren Smith filed a complaint March 14 in Orange County Circuit Court against Florida Peninsula Insurance Company, alleging failure to pay for losses sustained in a hurricane.
According to the complaint, on Sept. 11, 2017, Smith notified Florida Peninsula of the damages his property at 5132 Shale Ridge Trail, Orlando, sustained due to Hurricane Irma. Smith says he has complied with all conditions to entitle him to recover under the policy but has not received any insurance coverage that was required under the policy.
The plaintiff alleges Florida Peninsula Insurance has failed or refuses to fully perform under the policy and failed to fully pay Smith for the losses as required by the insurance policy.
Smith seeks trial by jury, damages of more than $15,000, plus interest on any overdue payments, attorney fees and court costs. He is represented by attorney David A. Spain of Morgan & Morgan PA in Orlando.
