ORLANDO — An Orange County man is suing Marriott, alleging violation of the Florida Consumer Collection Practices Act (FCCPA).
Michael Schlueter filed a complaint March 14 in Orange County Circuit Court against Marriott Resorts Hospitality Corporation, alleging unfair debt collection practices.
According to the complaint, some time before April 22, 2009, Schlueter incurred a debt associated with a time share that was to be paid to Mariott. The suit says starting Nov. 2, 2017, Schlueter has suffered anger, anxiety, emotional distress, fear, frustration, humiliation, and embarrassment, as a result of Marriott's illegal collection communications in an attempt to collect on an alleged debt, despite knowledge that the plaintiff is being represented by a legal counsel.
The plaintiff alleges Marriott Resorts Hospitality failed to ensure that no effort will be made to contact consumer debtors who are represented by attorneys, and caused emotional distress from its illegal and abusive collection practices.
Schlueter seeks trial by jury, actual and statutory damages, attorney fees and costs, injunctive relief and all further relief the court deems just. He is represented by attorney Joseph C. LoTempio of The Dellutri Law Group PA in Fort Myers.
