Orlando homeowner accuses insurer of breach of contract

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract and negligence.

Walter Berrios filed a complaint March 14 in Orange County Circuit Court against Southern Fidelity Insurance Company, alleging failed to pay for a covered loss. 

According to the complaint, Southern Fidelity breached the insurance contract by refusing to compensate Berrios for damages sustained to the building at 2505 Albaca Drive, Orlando, the building's contents, and the loss of use of the property and possessions, despite the cause of the damages being a covered loss. 

The plaintiff alleges Southern Fidelity Insurance refused to pay his claim, and required Berrios to retain the services of an attorney to represent and protect his legal interests.

Berrios seeks trial by jury, damages of more than $15,000, including damage to the building, contents, loss of use, interest allowed by law, plus attorney fees and costs. He is represented by attorney Peter Mineo Jr. of The Mineo Salcedo Law Firm PA in Davie.
