ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.
Julio Menoni filed a complaint March 14 in Orange County Circuit Court against Southern Fidelity Property & Casualty Inc., alleging the insurer failed to pay for damages caused by a hurricane.
According to the complaint, on Sept. 11, 2017, while Menoni's policy was in full force and effect, his property at 6219 Royal Oak Drive, Orlando, sustained a covered loss as a result of wind, wind-driven rain, and/or hail from Hurricane Irma. However, the suit says, Menoni has suffered and continues to suffer damages resulting from the defendant’s refusal to to pay for the plaintiff's losses.
The plaintiff alleges Southern Fidelity Property & Casualty has failed to properly indemnify Menoni for losses to the property, and failed to tender an appropriate amount to repair the property.
Menoni seeks trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. He is represented by attorneys Louis A. Gonzalez and Zaf Glenn Goss of Trujillo Vargas Gonzalez & Hevia LLP in Orlando.
