FORT LAUDERDALE — A Broward County property owner is suing an insurance company, alleging breach of contract.
Javier Cimetta filed a complaint March 8 in Broward County Circuit Court against People's Trust Insurance Company, alleging failure to set forth basic terms of any contractual arrangement for repairs, payment schedules and warranties for hurricane damages to his home.
According to the complaint, on Sept. 10, 2017, Cimetta's home at 11171 NW 35th St., Coral Springs, was damaged by wind and rain associated with Hurricane Irma. Despite performing his obligations to receive monetary assistance, the suit says, Cimetta was denied any compensation and denied his very basic right to contract and select who enters and perform repairs to his home.
The plaintiff alleges People's Trust Insurance failed to provide a policy with the basic information that is reasonably expected within a contract for repairs, and threatened to void any coverage obligation arising from the claim should Cimetta fail to complete the work authorization and return it to the company.
Cimetta seeks trial by jury, monetary damages of more than $15,000, attorney fees, court costs and all further relief the court deems just and proper. He is represented by attorneys Anthony J. Tinelli and Gabriel J. Fernandez of Mase, Tinelli, Mebane & Briggs in Miami.
