Georgia couple accuses Chevy dealer of fraudulent concealment

CLEARWATER — A Georgia couple is suing a Pinellas County Chevrolet automobile dealer, alleging fraudulent concealment and inducement.

David Baggett and Luvon Baggett filed a complaint Feb. 6 in Pinellas County Circuit Court against Dimmitt Chevrolet Inc,. alleging the defendant made false representations in order to induce clients into purchasing its vehicles.

According to the complaint, on Feb. 29, 2016, the Baggetts paid $36,388 for a used 2015 Chevrolet Volt. The suit says Dimmitt said the car had no previous accident history. 

On Aug. 5, 2016, the Baggetts said they were informed by their insurance company that the vehicle was involved in a prior accident that required almost $3,000 in repairs, which was never disclosed by Dimmitt Chevrolet.  

The plaintiffs allege Dimmitt Chevrolet failed to assist consumers in order to resolve the issues and falsely represented to the buyers that the vehicle was brand new when, in fact, it was not.

The Baggetts seek trial by jury, damages of more than $15,000, declaratory and injunctive relief, attorney fees and court costs, plus all further relief the court deems just and proper. They are represented by attorneys Roger D. Mason, II, Joseph V. Nemeh and John S. Valenti of Roger D. Mason II PA in Tampa.
