Customer accuses used car dealership of fraud

CLEARWATER — A Hillsborough County woman is suing a Pinellas County used car dealership, alleging fraud.

Julie Sheldon filed a complaint Feb. 6 in Pinellas Circuit Court against Fitzgerald Motors Inc., doing business as Fitzgerald's Countryside Automall, alleging the defendant sold her a defective Audi. 

According to the complaint, on Oct. 13, 2017, Sheldon purchased a used 2007 Audi A4 from the defendants for $7,200. The suit says Sheldon has been financially harmed from being enticed by the defendant to purchase a defective vehicle and by Fitzgerald's refusal to assist Sheldon with paying for repairs. 

The plaintiff alleges Fitzgerald's Countryside Automall concealed the defects on the Audi, failed to honor the warranty to repair any problems found within the week of purchase, failed to properly inspect the vehicle and provided plaintiff with a 138-point inspection that did not accurately reflect the condition of the vehicle.

Sheldon seeks trial by jury, damages between $5,000 and $15,000, attorney fees and court costs, plus all further relief the court deems just. She is represented by attorneys Roger D. Mason, Joseph V. Nemeh and John S. Valenti of Roger D. Mason II PA in Tampa.
