Orlando property owner alleges insurer failed to cover hurricane damage

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Arturo Muller Teran filed a complaint Feb. 2 in the Orange County Circuit Court against Florida Specialty Insurance Company, alleging failure to pay for damage caused by a hurricane. 

According to the complaint, on Sept. 11, 2017, while Teran's property at 1203 Sandestin Way, Orlando, was insured under a homeowners insurance policy, it sustained a covered loss due to Hurricane Irma. However, the suit says, despite Teran's efforts to perform all obligations precedent to recover money for damaged property under the policy, Florida Specialty has refused to provide coverage. 

The plaintiff alleges Florida Specialty Insurance has failed to fully pay for all of Teran's insurance losses and forced him to retain the services of an attorney.

Teran seeks trial by jury, judgment for the plaintiff’s losses of more than $15,000 with interest on any overdue payments, attorney fees and court costs. He is represented by attorney James J. Dye of Morgan & Morgan PA in Orlando.
