CLEARWATER — A Palm Harbor property owner is suing an insurance company, alleging breach of contract.
Maria Prieto filed a complaint Feb. 1 in Pinellas County Circuit Court against Citizens Property Insurance Corporation, alleging failure to comply with the terms of the policy to provide coverage.
According to the complaint, on May 10, 2017, while her policy with Citizens Property was in full force and effect, Prieto's insured property at 2570 Ridge Lane, Palm Harbor, sustained a covered loss from a sudden overflow of water from within the plumbing system on the premises. Despite the defendant inspecting and acknowledging the loss, the suit says, the insurance company refuses to adjust the coverage amount and adequately provide coverage under the terms of the policy.
The plaintiff alleges Citizens Property Insurance failed to acknowledge that additional payment would be forthcoming and it has failed to adequately provide coverage under the terms of the policy.
Prieto seeks trial by jury, damages of more than $15,000, plus interest, court costs and reasonable attorney fees. She is represented by attorney Thomas J. Morgan, Jr. of Morgan Law Group PA in Coral Gables.
