Orlando property owner accuses insurer of breach of contract

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Nicholas Feola filed a complaint Jan. 25 in Orange County Circuit Court against Modern USA Insurance Company, alleging failure to pay for a covered loss. 

According to the complaint, on April 17, 2017, the roof of Feola's property at 804 Eastcliff Court, Orlando, was damaged by a peril that it was insured against. However, Feola says he has suffered economic damages as a result of Modern USA's failure to pay full value for roofing and/or construction services to the plaintiff. 

The plaintiff alleges Modern USA Insurance failed or refused to reimburse him adequately for the damages, and forced Feola to retain the services of an attorney.

Feola seeks trial by jury, damages of more than $15,000, all unpaid and overdue insurance benefits with interest, plus court costs, attorney fees and all other remedies the court grants. He is represented by attorney Mark J. Dobo of Cohen Law Group in Maitland.
