Motorist alleges insurance carrier failed to cover crash damages

ORLANDO — An Orange County woman is suing an insurance carrier, alleging breach of contract.

Tiffany Johnson filed a complaint Jan. 2 in Orange County Circuit Court against USAA Casualty Insurance Company, alleging the defendant failed to cover the plaintiff's injuries from a car crash. 

According to the complaint, on Dec. 23, 2016, Johnson was involved in a vehicular accident caused by the negligence of, Brgida Mar Fernandez da Gomez an under-insured third party. However, the suit says, USAA Casualty failed to settle Johnson's claim for under-insured motorist benefits despite her timely report of the crash. 

The plaintiff alleges USAA Casualty Insurance failed to provide under-insured motorist protection coverage to Johnson and forced her to retain an attorney to represent her interest.

Johnson seeks trial by jury, full benefits owed the plaintiff, at least $15,000 in damages, attorney fees, court costs, interest and all further relief the court deems just. She is represented by attorney Joshua A. Andone of Hale, Hale & Jacobson PA in Orlando.
