Orlando homeowner alleges insurer failed to pay for hurricane damage

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.

Raul Giraud filed a complaint Dec. 26 in Orange County Circuit Court against Anchor Property & Casualty Insurance Company, alleging refusal to adjust the coverage loss.

According to the complaint, on Oct. 7, 2016, while his insurance policy with Anchor Property was in full force and effect, his property at 2141 River Park, Blvd., Orlando, sustained damage from Hurricane Matthew. Despite acknowledging that the property sustained a covered loss and exercised its right to repair, the suit says, Anchor Property has refused to adjust its evaluation of the loss and refuses to provide additional payment even after diligent inspection showed the property sustained covered damage greater than what was acknowledged by the defendant. 

The plaintiff alleges Anchor Property & Casualty Insurance has failed to acknowledge that payment would be forthcoming, failed to comply with the provisions of the insurance policy and failed to provide a statement detailing a justifiable reason for not providing payment.

Giraud seeks trial by jury, damages of more than $15,000, prejudgment interest, attorney fees and court costs. He is represented by attorneys Stephanie Balint and Robert L. Gioia of Homeowner Legal Solutions LP in Plantation.
