Consumer accuses collection firm of violating TCPA

CLEARWATER — A consumer is suing a collection firm, alleged violations of the Telephone Consumer Protection Act (TCPA).

Deannter Gill filed a complaint Dec. 21 in Pinellas Circuit Court against Navient Solutions LLC, alleging the collection firm violated the TCPA through intrusive and unwanted calls.

According to the complaint, in June 2013, Gill suffered from harassment and abuse due to the numerous unauthorized and harassing calls to his cellular phone in an attempt to collect on an alleged debt, while unlawfully utilizing an automatic telephone dialing system or an artificial or prerecorded voice. 

The plaintiff alleges Navient Solutions continued to make calls despite Gill's explicit demand to stop the improper calls. 

Gill seeks trial by jury, damages of $500 per violation, treble damages of $1,500 for every knowing violations, attorney fees, costs incurred, interest, and all further relief the court deems just. He is represented by attorney Randolph M. Giddings of Flynn Law Firm PA in St. Petersburg.
