ORLANDO — Orlando property owners are suing an insurance company, alleging breach of contract.
Jerry Gerena and Yamel Colon filed a complaint Dec. 20 in Orange County Circuit Court against American Integrity Insurance Company of Florida alleging, the insurer failed to cover damaged property.
According to the complaint, on Oct. 7, 2017, while the plaintiffs' property insurance policy was in full force and effect, their property at 1545 Sackett Circle, Orlando, sustained a covered loss as a result of wind, wind-driven rain, and/or hail. Although the plaintiffs say they promptly reported the loss to American Integrity, the defendant has refused to pay benefits for a covered peril.
The plaintiffs allege American Integrity Insurance has failed to properly indemnify the plaintiffs for their losses, and obligated them to retain attorneys for the prosecution of legal action.
Gerena and Colon seek trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. They are represented by attorneys Louis A. Gonzalez and Zaf Glenn Goss of Trujillo Vargas Gonzales & Hevia LLP in Orlando.
