Pinellas Park couple alleges insurer failed to cover hurricane damage

CLEARWATER — A Pinellas Park couple is suing an insurance company, alleging breach of contract.

Anthony Capella and Margot Capella filed a complaint Dec. 19 in Pinellas Circuit Court against Universal Property & Casualty Insurance Company, alleging failure to cover damages caused by Hurricane Irma. 

According to the complaint, on Sept. 11, 2017, the Capellas suffered substantial wind damage to the roof of their property at 8341 71st Court, Pinellas Park, caused by Hurricane Irma, a covered peril under their insurance policy. However, the suit says, Universal Property has failed to pay the plaintiffs' full benefits despite them giving the defendant prompt and timely notice of claims. 

The plaintiffs allege Universal Property & Casualty Insurance Company breached the terms of the policy by failing to pay full benefits due and owing, and forced the Capellas to retain and pay for legal counsel.

The Capellas seek trial by jury, damages in excess of $15,000, attorney fees, court costs and pre-judgment interest. They are represented by attorneys James S. Jenkins and Kelly-Ann Jenkins of Jenkins Law PL in St. Petersburg.
