Man alleges K. Hovnanian Homes refused to return escrow payment

ORLANDO – An Orange County man is seeking the return of a more than $40,000 escrow payment.

Hector Lozano filed a complaint on Nov. 30 in the 9th Judicial Circuit Court of Florida - Orange County against K. Hovnanian Homes, doing business as K. Hovnanian at Summerlake LLC, alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that on June 21, 2016, he entered into a purchase and sales agreement with defendant for the purchase of a property in Winter Garden. After providing escrow money in the sum of $44,300, plaintiff was denied by New American Funding for credit funding five months after its initial approval for the purchase of the home and requested defendant to return his escrow money. 

The plaintiff holds K. Hovnanian Homes responsible because the defendant allegedly refused and failed to return the $44,300 escrow money paid.

The plaintiff requests a trial by jury and seeks judgment for monetary and consequential damages of more than $15,000 including interest on all liquidated damages, attorneys' fees, costs, taxable costs, interest, and all other relief to which the court deems just and proper.
