Customer blames resort poolside bar owner for injuries

CLEARWATER — A West Virginia woman is suing a Treasure Island resort, alleging premises liability and negligence.

Kathleen Austin filed a complaint Nov. 27 in Pinellas Circuit Court against Treasure Island Palms LLC and Treasure Island Ocean Club LLC, alleging they failed to use due care to maintain its premises in a safe condition.

According to the complaint, on Dec. 3, 2016, Austin she was a business patron at the Treasure Island Palms poolside bar and restaurant. The suit says Austin fell from the uneven pavement along an unlighted area leading to the parking lot. 

As a result of the defendants' negligence, Austin says she sustained serious bodily injuries, disability, disfigurement, mental anguish, inconvenience, medical expenses, and loss of earnings. 

The plaintiff alleges Treasure Island Palms and Treasure Island Ocean Club failed to maintain adequate lighting in the area of Austin's accident, failed to provide warning of the dangerous condition, and failed to remedy the dangerous condition.

Austin seeks trial by jury, damages of more than $15,000, plus court costs, and all further relief the court deems proper. She is represented by attorneys Christopher J. Bolduc and Nicholas M. Athanason of Athanason & Bolduc PA in St. Petersburg.
