Policy holder alleges insurance carrier failed to pay for water damage

ORLANDO — An Orlando man is suing an insurance company, alleging breach of contract.

Gino Papi filed a complaint Nov. 28 in Orange County Circuit Court against Omega Insurance Company, alleging failure to pay for covered damages.

According to the complaint, on Feb. 7, 2017,  while Papi's insurance policy was in full force and effect, his property at 10231 Doriath Circle, Orlando, sustained a covered loss as a result of water damage. 

Although Papi says he has satisfied all post-loss obligations accorded in the policy, the defendant has refused to pay insurance benefits. 

The plaintiff alleges Omega Insurance has provided neither coverage nor payment to Papi for his losses stemming from the covered peril, and obligated the plaintiff to retain attorneys for legal action.

Papi seeks trial by jury, damages of more than $15,000, plus interest, court costs, attorney fees, and any other relief the court finds just. He is represented by attorneys Victor M. Llerandi Jr. and Alberto M. Regueyra of Regueyra & Llerandi PL in South Miami.
