ORLANDO — Two Orlando homeowners are suing an insurance company, alleging breach of contract.
Juan C. Salinas and Riselda Recio Lopez filed a complaint Nov. 27 in Orange County Circuit Court against Florida Peninsula Insurance Company, alleging the insurer failed to pay for damages caused by a leak.
According to the complaint, on Oct. 25, 2016, while the Florida Peninsula policy for Salinas and Lopez was in full force and effect, their insured property at 1102 Conway Road, Orlando, sustained a covered loss as a result of a plumbing leak.
The suit says although the defendant acknowledged the plaintiffs' property had sustained a covered loss and offered payment, it is not sufficient to cover for the losses.
The plaintiffs allege Florida Peninsula Insurance failed to provide coverage for the loss under the terms of the policy, failed to acknowledge that payment would be forthcoming, and failed to make adequate payment of insurance proceeds to the plaintiff.
Salinas and Lopez seek trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. They are represented by attorney Juan E. Mourin of The Law Offices of Grey & Mourin PA in Miami.
