Orange County landlord alleges tenant, guarantor breached lease agreement

ORLANDO — An Orange County landlord is suing a tenant and guarantor, alleging breach of a lease agreement and breach of guaranty.

Vast Peak Property LLC filed a complaint Nov. 16 in Orange County Circuit Court against Daves Canopies Inc., doing business as Dave's Flea Market, unknown parties in possession or occupancy and David S. Barker, alleging they breached their duties of good faith and fair dealing.

According to the complaint, on June 7, Vast Peak Property entered into a shopping center lease agreement with the defendant. The suit says Vast Peak has suffered monetary damages because the defendants breached and defaulted under the lease agreement and refused to surrender possession of the leased premises at 2009 Paula Michele Court, Ocoee. 

The plaintiff alleges the defendants forced Vast Peak to retain counsel to prosecute the case, breached the lease agreement and guaranty after failing to make proper payments due and outstanding under the agreement.

Vast Peak Property seeks trial by jury, damages of more than $15,000, attorney fees, costs of court and all further relief the court deems just. They are represented by attorney Matthew J. Brown of Mateer & Harbert PA in Orlando.
