Customer blames Walmart for fall, injuries

CLEARWATER — A customer is suing Walmart, alleging negligence caused the plaintiff to fall and suffer injuries.

Jose Sanchez filed a complaint Nov. 15 in Pinellas County Circuit Court against Wal-Mart Stores East LP, alleging failure to maintain its premises in a reasonably safe condition.

According to the complaint, on Aug. 31, 2105, Sanchez he was a business invitee at the Walmart, 3801 Tampa Road, Oldsmar. The suit says Sanchez slipped and fell on a water on the floor, resulting from an overflowing toilet in the bathroom. As a result, Sanchez says he suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical and treatment expenses and loss of the ability to earn money. 

The plaintiff alleges Wal-Mart Stores East failed to warn customers of the dangerous condition that existed in the premises and failed to maintain and regularly inspect the floor to ensure it was safe.

Sanchez seeks trial by jury, costs and damages and court costs. He is represented by attorney Rolando G. Guerra, Jr. of Gibbs & Parnell PA in Tampa.
