Broward County homeowner alleges remodeling business breached contract

FORT LAUDERDALE — A Broward County property owner is suing a remodeling business, alleging breach of contract.

Cheryl Fialkin of Margate filed a complaint Nov. 1 in Broward County Circuit Court against Evilazio Silva, alleging the defendant breached the contract agreement by failing to perform remodeling services.

According to the complaint, Fialkin she entered into a written agreement with Silva wherein, under his trade name SM Construction, the defendant would perform the remodeling of her kitchen at 3155 Holiday Springs, Blvd., Margate, in exchange for $22,500. 

Fialkin says she made full payment but did not receive proper remodeling to her kitchen as it was left unfinished. 

The plaintiff alleges Silva failed and refuses to complete the work, failed to use licensed subcontractors, failed to properly install the cabinets and damaged the kitchen's electrical system necessitating a repair to the wiring.

Fialkin seeks trial by jury, monetary and treble damages of more than $15,000, disgorgement of monies, pre and post-judgment interest, plus all other relief the court deems just and proper. She is represented by attorneys Brian A. Wolf and Miles D. Jolley of Smith, Currie & Hancock LLP in Fort Lauderdale.
