Late 02

CLEARWATER — A roofing distributor is suing a customer, alleging breach of contract and failure to pay more than $31,000.

SRS Distribution Inc., doing business as Suncoast Roofers Supply, filed a complaint Oct. 19 in Pinellas County Circuit Court against Terk's Roofing Inc., alleging breach of good faith and fair dealing.

According to the complaint, Suncoast Roofers Supply suffered monetary damages from entering into a business transaction with Terk's, for providing roofing materials and supplies without receiving the agreed upon balance of $31,300.89.

The plaintiff alleges Terk's Roofing has breached the terms of the contract by failing to make payment as set forth, and forced the plaintiff to retain a legal counsel to protect its interest.

Suncoast Roofers seeks trial by jury, damages of at least $31,300.89, plus attorney fees and court costs. It is represented by attorney Robert E. Burguieres of Arnold & Burguieres in St. Petersburg.
