Insurance firm accuses Interline Brands of designing defective product

ORLANDO — An insurance firm is suing  a wholesale company, alleging the defendant designed a defective toilet supply line. 

Tower Hill Prime Insurance Company, as subrogee of Evelyn Meany, filed a complaint Oct. 10 in Orange County Circuit Court against Interline Brands Inc. alleging failure to provide toilet supply lines to the general public in a manner fit for its intended purpose that would not cause the supply line to become compromised.

According to the complaint, on Aug. 1, 2014, one of Tower Hill Prime's insured properties at 644 Lake Biscayne Way, Orlando, sustained property damage losses due to the DuraPro Band toilet supply line that malfunctioned.

The suit says the malfunction caused damages to Meany's residence and to her personal belongings. Tower Hill Prime says it was forced to pay $55,182,08 for the property damage suffered by Meany, an amount that should be paid by Interline Brands because the defective product was manufactured by them. 

The plaintiff alleges Interline Brands failed to manufacture a toilet supply line free from defect that resulted in the damage of property.

Tower Hill Prime Insurance seeks trial by jury, judgment of $55,182.08 for damages, plus interest and court costs. It is represented by attorney Bruce H. Schiller of Law Office of Yates & Schiller, PA in Boca Raton.
