Orlando property owner alleges insurer breached contract

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Jose Alejo filed a complaint Oct. 10 in Orange County Circuit Court against Castle Key Insurance Company, alleging the insurer breached its duty of good faith and fair dealing.

According to the complaint, on Jan. 30,  Alejo suffered a property loss due to water discharge in the kitchen of his home at 12636 Illinois Woods Lane, Orlando, a peril covered under the policy. However, the suit says Castle Key refused to honor its contractual obligations to protect Alejo's assets and pay for the covered loss. 

The plaintiff alleges Castle Key has failed to make a coverage determination in violation of Florida statute, refused to properly investigate the claim, and failed its duty to adjust the loss properly, promptly and accurately.

Alejo seeks trial by jury, damages of at least $15,000, plus costs, prejudgment interest and attorney fees. He is represented by attorney Jonathan Drake of Strems Law Firm in Coral Gables.
