ORLANDO — A Manatee County man is suing Carmax, alleging negligence and vicarious liability led to the plaintiff being run over.
Jason Martin filed a complaint Oct. 3 in Orange County Circuit Court against Carmax Auto Superstores Inc., alleging failure to follow applicable safety guidelines and regulations.
According to the complaint, on Feb, 21, 2014, Martin was lawfully in Carmax's parking area at 6375 S. Semoran Blvd., Orlando. The suit says Martin was removing a sewer cap for a work contracted by his employer, Dragon Plumbing, when a Carmax employee carelessly operated a motor vehicle owned by the defendant.
The lawsuit states the Carmax vehicle collided with plaintiff, causing Martin to sustain permanent injuries to his body, disability, physical impairment, disfigurement, mental anguish, inconvenience, aggravation of an existing condition, medical expenses and loss of earnings.
The plaintiff alleges Carmax Auto Superstores negligently operated and/or maintained the motor vehicle, and obligated Martin to retain and pay for legal counsel to represent and protect his interest.
Martin seeks trial by jury, damages that exceed $15,000, exclusive of interest, court costs and attorney fees, plus all other proper relief. He is represented by attorney Nicholas P. Panagakis of Morgan & Morgan PA in Orlando.
