Patient blames clinic, employee for nerve damage

ORLANDO — A Orange County patient is suing an Orlando diagnostic clinic and employee, alleging negligence led to her suffering nerve damage.

John Fudali filed a complaint Sept. 29 in the Ninth Judicial Circuit Court in Florida Orange County against Quest Diagnostics, Inc. and Emily Iglesias, alleging they failed to exercise ordinary skills, learning and practice as a phlebotomist.

According to the complaint, on July 7, 2015, Fudali continued to experience severe pain in his elbow and arm after having his blood drawn by Iglesias. After seeking medical treatment, the suit says, Fudali learned the nerve in his arm had been damaged during the blood draw and he had to undergo painful surgery to repair the nerve. 

Fudali alleges he suffered bodily injury resulting in pain and suffering, impairment, mental anguish, loss of capacity for the enjoyment of life and medical expenses. The plaintiff alleges the defendants failed to provide safe medical testing services, specifically the routine blood drawing ,and failed to respond appropriately to notice of the possibility of injury.

Fudali seeks trial by jury, compensatory damages of at least $15,000, court costs, attorney fees and all other just relief. He is represented by attorney Jeffrey S. Badgley of Badgley Law Group in Orlando.
