Customer blames Wal-Mart for fall, injuries

CLEARWATER — A Pinellas County woman is suing Wal-Mart, alleging negligence led to fall that caused injuries to the plaintiff.

Kara Miller filed a complaint Sept. 25 in Pinellas County Circuit Court against Wal-Mart Stores Inc. and store manager Peter Nielsen, alleging they failed to use ordinary care to maintain its premises in a safe condition.

According to the complaint, on April 24, 2016, Miller went to the Wal-Mart store on U.S. Highway 19 in Pinellas County as a customer. The suit says Miller slipped on a substance around the beverage aisle near the water filling station that appeared to be water and/or a liquid substance that Wal-Mart employees allowed to remain on the floor. 

As a result of the defendants' negligence, Miller says she suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish and aggravation of a previously existing condition. 

The plaintiff alleges the defendants failed to train its employees as to policies and/or procedures for the protection of its customers, and failed to exercise due care in the maintenance, inspection, and repair of the store premises.

Miller seeks trial by jury, damages of more than $15,000 exclusive of interest, court costs and attorney fees. She is represented by attorney Darren W. Kropog Jr. of Morgan & Morgan, Tampa PA in St. Petersburg.
