ORLANDO — An Orange County mother is suing Wal-Mart and a female employee, alleging the assault of a minor child.
Alicia Branford, as mother a minor child, Alexander Branford, filed a complaint Sept. 19 in the Ninth Judicial Circuit Court of Florida Orange County against Jane Doe and Wal-Mart Stores, Inc., alleging the defendants failed their duty to exercise ordinary care in treating customers properly in a business that is open to the public.
According to the complaint, on July 2, 2016, Branford and her minor child were customers at Wal-Mart's Sam's Club Warehouse in Orlando when Alexander Branford was assaulted and battered by Jane Doe. As a result, the suit says, the son suffered serious and permanent injuries and emotional distress.
The plaintiff alleges Wal-Mart failed to exercise reasonable care to employ a competent and careful employee, and failed to ascertain whether the employee was competent to do the work safely.
Alicia Branford seeks trial by jury, damages of more than $15,000, plus court costs and all other relief deemed appropriate. She is represented by attorney Lemar F. Alejo of Alejo Law, PA in Orlando.
