Couple accuses General Motors of breach of warranty

FORT LAUDERDALE — A Florida couple is suing General Motors, alleging breach of warranty.

Cesar A. Niada and Sussell Yusilem Niada filed a complaint Sept. 22 in Broward Circuit Court against General Motors LLC, alleging the defendant breached its duty of good and fair dealings.

According to the complaint, on June 28, 2015, Cesar A. Niada and Sussell Yusilem Niada paid $45,471 to least a GMC Yukon XL that turned out to be defective. The suit says the GMC Yukon has been subject to repair several times for the same defects and the defects remains uncorrected. The Niadas say the vehicle is substantially impaired in its use value and safety due to problems with the transmission, engine and electrical system a non-functioning air conditioning system. 

The plaintiffs allege General Motors negligently allowed a defective product to be on the market and failed to adequately and timely repair the defects of vehicle.

The Niadas seek trial by jury, revocation of acceptance of the vehicle, return of all monies paid, all damages incurred, reasonable attorney fees, all court costs and all other fees and all other relief the court deems just and appropriate. They are represented by attorney Mohamed Z. Somji of Krohn & Moss Ltd in Chicago.
