ORLANDO — A financing company is suing a vehicle owner, alleging breach of contract in failure to pay more than $8,000.
Investment Retrievers Inc. filed a complaint Sept. 11 in the Ninth Judicial Circuit Court of Florida Orange County against Jose Agustin Diaz, also known as Jose Diaz III, alleging the defendant failed to perform all conditions required under the sales contract agreement.
According to the complaint, on Nov. 24, 2009, the parties entered into a written contract whereby Diaz agreed to buy a 2010 Nissan Altima with a monthly installment of $731.62 starting Dec. 24, 2009, until the entire total payment of $43,897.20 was paid in full. Investment Retrievers allege it has failed to receive monthly payments despite performing all conditions of the contract.
The plaintiff alleges Diaz failed to make monthly due payments, failed to pay the remaining balance to redeem the vehicle and failed to pay deficiency balance in the sum of $8,389.76.
Investment Retrievers seek trial by jury, judgment of at least $8,389.76, costs of suit incurred, attorney fees, and all other relief the court deems proper. It is represented by attorney Nathan A. Schwartz of Pompano Beach.
