Federated National Insurance Company accused of breaching insurance contract

Insurance 03

ORLANDO — An individual is suing Federated National Insurance Company for alleged breach of contract.

Paula Perez filed a complaint on Aug. 17 in the Orange County Circuit Court, alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that her property suffered damages on Dec.12, 2014 due to a broken pipe. Although the defendant allegedly acknowledged coverage for the loss and issued a payment to the plaintiff, the defendant allegedly rejected the total amount of damages and paid an amount insufficient to cover the damages.

The plaintiff holds the defendant responsible for allegedly failing to honor its contractual obligation and fully pay for the damages to her property.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages plus costs, pre-judgment interest and attorney's fees. She is represented by Jonathan Drake of Strems Law Firm in Coral Gables.
