Universal Orlando Resort accused of negligence

ORLANDO — Two individuals are suing Universal City Development Partners Ltd. d/b/a Universal Orlando Resort for alleged negligence and loss of consortium.

Julietta and Alexander Tello filed a complaint on Aug. 8 in the Orange County Circuit Court, alleging that the defendant failed to maintain its premises in safe conditions.

According to the complaint, the plaintiffs allege that Julietta Tello was on the defendant’s premises on Oct. 18, 2013 when her heel allegedly got stuck in the drainage hole of a manhole cover, which allegedly caused her to fall and twist her left ankle. The plaintiff claims that she was seriously injured and rendered sick, sore and otherwise disabled, while her husband allegedly lost his wife's society, companionship, services and consortium. 

The plaintiffs hold the defendant responsible for allegedly failing to place barricades, cones or other warning devices adjacent to the manhole cover to alert patrons, and for allegedly failing to correct the placement of the manhole cover.

The plaintiffs request a trial by jury and seek judgment from the defendant for damages in excess of $15,000 together with costs of suit and any further relief the court deems just and proper. They are represented by Paul G. Finizio of Finizio & Finizio PA in Fort Lauderdale.
