Universal Insurance Company of North America accused of breach of contract

ORLANDO — Two individuals are suing Universal Insurance Company of North America for alleged breach of contract.

Matthew and Maureen Melillo filed a complaint on Aug. 3 in the Orange County Circuit Court, alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that her property sustained a covered loss on June 22 as a result of water and mold damage due to an HVAC leak. However, the defendant allegedly has denied coverage for the loss, arguing that it was not covered by the policy. 

The plaintiffs hold the defendant responsible for allegedly failing to acknowledge that payment would be forthcoming and for allegedly failing to pay insurance proceeds to them.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, plus interest, court costs, attorney’s fees and any further relief the court deems appropriate. They are represented by David Low of David Low & Associates PA in Fort Lauderdale.
