FORT LAUDERDALE — An individual is suing Citizens Property Insurance Corporation for alleged breach of contract.
Cortney S. Arce filed a complaint on Aug. 1 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that her property sustained damages on Dec. 9, 2016 as a result of tile damage due to a loose floor tile. Though the plaintiff allegedly furnished timely notice of the damages, the defendant allegedly refused to pay either part or all of the plaintiff's claim.
The plaintiff holds the defendant responsible for allegedly failing to acknowledge coverage, acknowledge that payment would be forthcoming and for allegedly failing to make any payment of insurance benefits.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, court costs, attorney's fees and any further relief the court deems just. She is represented by David Low of David Low & Associates PA in Fort Lauderdale.
