ORLANDO — Travel club members have filed a class-action lawsuit against Gold Crown Resort Marketing Inc. for alleged breach of contract, fraud and unjust enrichment.

Timothy Phillpotts, Susan Taylor, Bethann E. Ritter Snyder, Eric Hillis and Karen Confer filed the complaint on July 18 in the Orange County Circuit Court, alleging that the defendant obtained profit through unfair or deceptive trade or commerce.

According to the complaint, the plaintiffs allege that they and other similarly situated club members have sustained damages as a result of the defendant's alleged deceptive and unfair practices of attempting to charge and collect an unlawful and unauthorized annual registration fee. If the plaintiffs didn't pay the fee, the defendant allegedly would block them from participating in its private travel club and exclusive holiday program until the fee was paid.

The plaintiffs hold the defendant responsible for allegedly breaching membership agreements that stated that any annual registration fees are waived, and for allegedly benefiting from the collection of an annual registration fee.

The plaintiffs request a trial by jury and seek judgment against the defendant for any and all damages sustained, including taxable costs and pre-judgment interest and any additional relief the court deems fair.
