ORLANDO — A motorist is suing the Florida Highway Patrol alleged negligence, battery, infliction of emotional distress and trespass.
David Richard Bachelor filed a complaint on June 22 in the Orange County Circuit Court, alleging that the defendant caused him life threatening injuries, pain and suffering.
According to the complaint, the plaintiff alleges that he was chased in his vehicle on Nov. 18, 2013 by a trooper employed by the defendant. When the plaintiff allegedly made it home, the trooper's taser allegedly failed to hinder him from entering his house. After failing to prevent the plaintiff from entering the house, the trooper allegedly then fired seven gunshots into the front door of the house. As a result, one shot allegedly struck plaintiff in the head and caused injury, inconvenience, pain and discomfort, disgrace and medical bills.
The plaintiff holds the defendant responsible for allegedly causing him harm, violating his privacy rights and breaching its duty of care by opening fire on his home.
The plaintiff requests a trial by jury and seeks judgment in his favor for compensatory damages, interest, costs and further relief the court deems just. He is represented by Howard S. Marks of Burr & Forman LLP in Orlando.
