Hollywood homeowners seek payment of damage claim from insurer

FORT LAUDERDALE – The owners of a Hollywood property allege they submitted a property damage claim to their insurer but that the company has not paid it.

Tania Padilla and Robert Grullon filed a complaint on June 6 in the 17th Judicial Circuit Court of Florida - Broward County against Florida Peninsula Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Feb. 7, their home sustained a covered loss due to a broken or leaking pipe that required necessary repairs and replacements.

The plaintiffs hold Florida Peninsula Insurance Co. responsible because the defendant allegedly failed to establish proof that it was not responsible for the payment of covered losses and failed to pay the requested amounts for repairs and/or replacements.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, interest, attorney's fees, costs, and other relief that the court deems just. They are represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
