Winn-Dixie shopper alleges she was injured by shelf in store

ORLANDO – A shopper at an Orlando Winn-Dixie alleges she was injured because of a promotional shelf extension in the store.

Veronica White filed a complaint on June 1 in the 9th Judicial Circuit Court of Florida - Orange County against Winn-Dixie Stores Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on June 9, 2013, she was shopping in the store premises of the defendant when she struck her head on the shelf extension as she attempted to stand after stooping to reach the lower shelves. As a result, she alleges she suffered bodily injury and resulting pain and suffering, disability, disfigurement, lost wages, aggravation of pre-existing conditions and incurred medical expenses. 

The plaintiff holds Winn-Dixie Stores Inc. responsible because the defendant allegedly failed to warn plaintiff, failed to keep the premises clear of hazards and failed to adequately maintain and inspect the premises.

The plaintiff requests a trial by jury and seeks judgment against defendant, monetary damages and costs of prosecution. She is represented by Steven J. Kirschner and Christopher J. Konicek of Kirschner & Konicek PLLC in Winter Park.
